Planning Appeals

 

An applicant may appeal against the decision of Maidstone Borough Council to refuse permission or if they do not agree with the conditions imposed on a grant of planning permission or we have failed to reach a decision on an application within an agreed timescale.

 

If an application has been refused, permitted subject to conditions and you do not agree with the conditions, or we have failed to make a decision within 8 weeks (non-determination) the applicant has the right to appeal to the Secretary of State. This is a last resort decision and it can take several months to decide, it may therefore be quicker to discuss with us how to amend you proposal to make it more acceptable.

If you are considering appealing to the decision notice you must do so within 6 months of the date of the decision notice, or in the case of non-determination, 6 months from the decision due date. You can do this by using a form available from the Planning Inspectorate, Temple Quay House, 2 The Square, Temple Quay, Bristol, BS1 6PN.
